General David B. Birney was born in Huntsville, Alabama on May 29, 1825. His family moved to Kentucky in 1833 and Ohio in 1835 and eventually to Philadelphia, Pa. Birney was practicing law in Philadelphia when the Civil War started and was appointed Colonel of the 23rd Pennsylvania also known as "BIRNEY'S ZOUAVES." He was promoted Brigadier General and served as a brigade commander in the Peninsula Campaign. At the Battle of Seven Pines he was accused of disobeying an order from his Corps Commander. He was court-martialed but testimony from his Division Commander showed that it was just a case of misunderstood orders. He served at 2nd Bull Run and when his Division Commander was killed Birney took over the Division. Birney commanded his Division at Fredericksburg, Chancellorsville and Gettysburg. In the latter battle he was twice wounded and took command of the 3rd Corps when Major General Dan Sickles was wounded. Birney commanded the Corps until February of 1864. During the Overland Campaign Birney commanded a Division in the 2nd Corps at the battles of the Wilderness, Spotsylvania, where he was again wounded and Cold Harbor. In July 1864 Gen. Grant gave Birney command of the 10th Corps of the Army of the James. During the Siege of Petersburg Birney fell ill with malaria or typhoid and died three months later at his home in Philadelphia.
